What happens if you claim too much tax credits?

If the claim that caused the overpayment has ended and HMRC cannot collect the money back from ongoing payments of tax credits they will try and recover the debt directly from you. When this happens, HMRC pass the collection to their Debt Management section.

What happens if I dont pay my tax credits overpayment?

What happens if you don’t pay back tax credit overpayments? If you don’t pay back the money you owe, the HMRC and DWP can take further action to recover the money you owe. They may: Pass the debt to a debt collection agency to contact you: Debt collectors are not bailiffs and don’t have any extra powers.

An overpayment means we’ve paid you more money than you’re entitled to. If you think the amount of tax credits is wrong, you can ask us to look at the decision again. This is called mandatory reconsideration and you must normally contact us within 30 days of the date shown on your decision notice.

What to do if you get overpayment on tax credits?

Ask for a breakdown of the overpayment as you have mislaid your previous tax credits provisional and final award notices from those years. If they say they cant, ask to be put through to a supervisor. When you get the breakdowns, take them to CAB to make sure you understand them and to discuss your options.

When do you have to pay back tax credits?

The first one was from 2004/2005 for £566.77, then 2005/2006 for £331.38, then 2008/2009 for £3231.66 and finally 2009/2010 for £3037.26 all to be paid by 26th May or you can pay over 12 months. My husband and I got a letter each apart from the 2004/2005 one which only my husband received.

How to keep up to date with tax credits?

Customers are advised to keep us up to date with all changes to reduce the amount of any overpayment which may build up. To confirm changes that need to be reported within one month, follow the guidance in TCM0224260. If the customer did not have any changes to report, go to Step 3.

When does HMRC need to remit an overpayment?

Where you identify the overpayment has been created due to HMRC and / or the customer failing to meet one or more of their responsibilities, this guidance will help you to decide, if the overpayment should be remitted – because HMRC has failed to meet one or more of its responsibilities and the customer has met all their responsibilities
